ZONING BOARD OF APPEALS
        DECEMBER 11, 2008
        MINUTES

Members Present:  Roger Thurston (Vice Chairman), Don Intonti (Clerk), John Zazzaro, George Reinhart, David Fleming (Alternate), Stephen Wasby (Alternate).
Absent:  John Lennox (Chairman).  
Staff Present: Frank DeFelice/Building Inspector, Sarah Raposa/Town Planner.

Vice Chairman Roger Thurston called the meeting to order at 7:00 p.m.

Alternate Stephen Wasby was asked to sit on Board for Appeals #Z2008-08 and #Z2008-12.

Special Permits or Variances
Appeal #Z2008-08 -  Brackett Farms, LLC, Mary Jacoby seeks relief in the form of a special permit or variance from the sign regulations in the Town of Eastham Zoning By-Laws Section II. to put a sign upon the west exterior wall of the premises identifying the business name, Sam's Deli, on property  located at 100 Brackett Road, Map 08 Parcel 165.

Attorney Jennifer Parkas Ellis explained applicants reasoning for a continuance.    

A MOTION to grant a continuance of Appeal #Z2008-08 to the next Zoning Board of Appeals meeting, January 8, 2009, was made by Don Intonti and Seconded by John Zazzaro.  
The VOTE: 5-0 IN FAVOR B Don Intonti, Roger Thurston, John Zazzaro, George Reinhart and Stephen Wasby.   OPPOSED - NONE.
Granted Continuance.

Appeal #Z2008-12 - EASTHAM LIBRARY BUILDING COMMITTEE seeks relief  from  Town of Eastham Zoning Bylaws Section III  for special permit or variance as proposed project exceeds height limits by 6.5 feet on property located at 160 Samoset Road, Map 15 Parcel 036A.

Joseph Sullivan requested continuance to prepare plans.

Stephen Wasby questioned  the reason the Town Clerk and the Assistant Town clerk submitted a letter and whether it was because they thought the entire project was being reviewed tonight.  The Board asked the Town Planner to inquire and clarify.

A MOTION to grant a continuance of Appeal #Z2008-12 to the January 8, 2008 Zoning Board of Appeals meeting was made by Stephen Wasby and Seconded by John Zazzaro.  
The VOTE: 5-0 IN FAVOR B Stephen Wasby, Don Intonti, Roger Thurston, John Zazzaro, and George Reinhart.   OPPOSED - NONE.
Granted Continuance.

Minutes
A MOTION to accept the Minutes of the November 13, 2008 meeting was made by Don Intonti and Seconded by John Zazzaro.  
The VOTE: 4-0-1 IN FAVOR B Don Intonti, George Reinhart, John Zazzaro, and Roger Thurston.  ABSTAINED: Stephen Wasby.  OPPOSED - NONE.
Minutes accepted.

Other Business
Town Planner announced opportunity for zoning articles and comments.

Building Inspector proposed a change in the meeting time to 5:00 p.m. at least for the winter as a convenience.  Board will consider at the next meeting.

Town Planner advised that Appeal No. Z2008-10, 7 West Shore Drive was ongoing and may need to be continued.  Vice Chairman suggested a withdrawal without prejudice.

Adjournment
A MOTION to adjourn was made by Don Intonti and Seconded by Stephen Wasby.  
All in favor.
