ZONING BOARD OF APPEALS
May 10, 2007
MINUTES

Members Present:   John Lennox, Chairman, Kathryn Sette, Vice Chairman, Roger Thurston, Clerk, Victoria Dalmas, Don Intonti, David Fleming, Alternate

Chairman John Lennox called the meeting to order at 7:00 p.m.

Case Zoning Board of Appeals 2007-06  

        Dorothy Daniels - 33 Bayberry Lane - Map 13 - Parcel 158
Applicant requests a Special Permit under Eastham Zoning By-Laws Section VI Non-Conforming Uses, Part C, for relief from side setback for a non-conforming property.

        Applicant represented by Builder Art Cestaro.

        FINDINGS OF FACTS:

        Existing dwelling is a pre-existing non-conforming structure.  
        Proposed addition is located within the side and front setbacks and it does not make the dwelling more non-conforming.  
        Applicant wishes to add decks on the front and rear of the building which will make the structure more non-conforming on the side and rear setbacks but the addition will be no closer than the existing structure to the side setback.  
        Applicant has received approval of site plan review by the Planning Board.
        Part of the existing dwelling is 6" from the side setback.
        Board of Health has approved a 3-Bedroom septic plan with secondary treatment (“microfast”).
        Project has received approval from the Conservation Commission.
        Proposed Improvements to this dwelling will be consistent with current  alterations in the neighborhood.  
        
MOTION was made by Victoria Dalmas to accept findings and SECONDED by Kathryn Sette.   

VOTE:   IN FAVOR :   Dalmas, Intonti, Lennox, Sette, Thurston
               OPPOSED:     None       
                PASSED as submitted 5-0   

MOTION was made by Roger Thurston to grant a Special Permit to the Applicant to proceed with the plans and the Board finds that the application is not detrimental to the neighborhood nor does it derogate from the public good.  SECONDED by Victoria Dalmas.

VOTE:    IN FAVOR:  Dalmas, Intonti, Lennox, Thurston  
                 OPPOSED:  Sette
                 PASSED:      4-1

MOTION was made by David Fleming to accept the Minutes of the April 12, 2007 meeting and   SECONDED by Kathryn Sette.

VOTE:   IN FAVOR:  Dalmas, Fleming, Lennox, Sette, Thurston  
                OPPOSED:  None
                 PASSED:      5-0

Note:  David Fleming present at April meeting.  Donald Intonti was absent from April meeting.

Case Zoning Board of Appeals 2006-12
        
        Barbara and John R. McDonald - 75 Knowles Street - Map 12 - Parcel 75A

MOTION was made by Kathryn Sette to reschedule this case until the June 14, 2007 Meeting and SECONDED by Victoria Dalmas.

VOTE:    IN FAVOR:  Dalmas, Intonti, Lennox, Sette, Thurston  
                 OPPOSED:   None
                 PASSED:      5-0

Building Inspector will notify Applicants of this change and the intent of the Zoning Board of Appeals to hear Case Z2006-12 at the June 14th meeting.

The Massachusetts Federation of Planning and Appeals Board is holding its Spring area meeting of Cape and the Islands in Falmouth.  If going, sign up and submit to the Town directly.  

MOTION made by Roger  Thurston to adjourn and SECONDED by Kathryn Sette.  Meeting adjourned at 7:50 p.m.
