ZONING BOARD OF APPEALS
AUGUST 10, 2006
MINUTES

Members Present: John Lennox-Chairman, Kathryn Sette, Victoria Dalmas and John                                           Zazzaro, Alternate   
                             
Staff Present:          Frank DeFelice, Building & Zoning Inspector and
                                        Mary Elizabeth Burgess, Town Planner

Mr. Lennox   called the meeting to order at 7:00  PM.

Mr. Lennox explained that because there were only four (4) members present to hear cases and that most cases required four  (4)  votes in favor, applicants could choose to delay hearing of their cases until the next meeting on September 14, 2006, when he anticipated that a full board of five (5)  would be present.

CASE Z2006-05 -JAMES K. & AMANDA W. BAUGHMAN request VARIANCE/SPECIAL   PERMIT under Eastham Zoning By-Laws, Section VI, Paragraph D to construct a bicycle shed (12' X 10') with an 8' ramp on property located at 300 Samoset Road, Eastham, Map-14 Parcel-135.  

Peter McDonald, agent for the owners, requested a continuance to the next meeting of the ZBA on  September 14, 2006.

A MOTION was made by Ms. Sette, SECONDED by Ms. Dalmas to continue Case Z2006-5, to September 14, 2006 meeting of the ZBA.

VOTE: IN FAVOR (4) Lennox, Sette, Dalmas and Zazzaro
            AGAINST: NONE

CASE Z2006-07 - LOUISE KANE, requests a Special Permit under Eastham Zoning By-Laws     Section VI, Paragraph C to renovate existing dwelling and convert existing deck to a sunroom for property located at 18 Beach Plum Lane, Eastham, Map-13 Parcel-208.

After a discussion it was determined that different plans had been submitted to the Health Agent.  Ms Kane requested that the application be withdrawn without prejudice until a new application with complete details could be submitted.


A MOTION was made by Ms. Sette, SECONDED by Ms. Dalmas to permit Case Z2006-07 to be withdrawn without  prejudice.

            AGAINST: NONE
CASE Z2006-08  - SHARON NIQUETTE, requests a Special Permit under Eastham Zoning By-    Laws Section V-Uses-District A to install a pre-built horse barn (10'X12') within the setbacks for property located at 1 Johanna Lane, Eastham, Map-21 Parcel-028-H.

Findings of Facts:

1. Property consists of .069 acres or 3,000 sq. ft. with a 1,272 sq. ft. house.
2. The applicant proposes to erect a pre-fab shed, 10'X12' with 7' sides, meeting all required setbacks
3. The applicant plans to keep a horse and related supplies in the shed and maintain a clean area.
4. Special permit is required to house animals in District A-Section V.
5. The ZBA requires a waste management plan including, as a minimum, procedures for cleaning the stall, barn and corral and the type of air tight containers for waste and a schedule for frequency of disposal, as well as a drawing of the area to be used as a corral.
6. The corral is to be fenced with electric fencing which will be partly on the adjacent lot.
7. A deed permits use of the adjacent lot for the horse corral.
8. An abutter expressed concerns about waste disposal and storage of hay.
9. The owner of the adjacent property (where the corral extends) spoke in favor.

A MOTION was made by Ms. Sette, SECONDED by Mr. Zazzaro to accept the Findings as read.

VOTE: IN FAVOR (4) Lennox, Sette, Dalmas and Zazzaro
            AGAINST: NONE
A MOTION was made by Ms. Sette, SECONDED by Mr. Zazzaro to Grant a Special Permit to Sharon Niquette to install a pre-built horse barn (10' X 12') with the following conditions:
The applicant will submit a satisfactory waste management plan to be  approved by the Chairman of the ZBA as part of the permit.

VOTE: IN FAVOR (4) Lennox, Sette, Dalmas and Zazzaro
            AGAINST: NONE

A MOTION was made by Ms. Sette, SECONDED by Mr. Zazzaro to adjourn at 7:45 PM
