ZONING BOARD OF APPEALS
JULY 13, 2006
MINUTES

Members Present: John Lennox-Chairman, Kathryn Sette, Roger Thurston, William  Nugent,     Robert Bylaska, Donald Intonti , Alternate and David Fleming, Alternate                               
Staff Present:          Frank DeFelice-Building & Zoning Inspector

Mr. Lennox (Chairman)  called the meeting to order at 7:00  PM.

CASE Z2006-05 -JAMES K. & AMANDA W. BAUGHMAN request VARIANCE/SPECIAL   PERMIT under Eastham Zoning By-Laws, Section VI, Paragraph D to construct a bicycle shed (12' X 10') with an 8' ramp on property located at 300 Samoset Road, Eastham, Map-14 Parcel-135.  

A request was made by the Agent for a continuance to the next meeting of the ZBA (8/10/06).

A MOTION was made by Ms. Sette, SECONDED by Mr. Bylaska to continue Case Z2006-5, to August 10, 2006 meeting of the ZBA.

VOTE: IN FAVOR (5) Lennox, Thurston, Bylaska, Nugent and Sette
            AGAINST: NONE

CASE Z2006-06 - ROBERT E. CLEARY, requests a Special Permit under Eastham Zoning        By-Laws Section V District A to house a horse in existing building located at 101 Dyer Prince Road, Eastham, Map-19 Parcel-102.

FINDINGS OF FACTS:
1. Property consists of  3.1 acres with 0.7 wetland, 2.4 acres upland
2. Conservation Commission reviewed and found no objections to the proposal.
3. There were no objections from abutters or neighbors. (Attorney Landreth represented one                   neighbor and asked for clarification.)
4. The Applicant intends to house a horse in a structure (21' X 12') designated as “existing                        garage” on the certified plot plan.

5. The Applicant intends to maintain a clean and odor free yard and stall.  He will collect all            waste and store it in a closed container.  Manure will eventually be left at the appropriate          area of the Town Landfill.. The Applicant will maintain stall and grounds in a clean and               acceptable manner.
6. The Applicant will install a modern electrical perimeter fence enclosing approximately       3000-3500 sq. ft. in rear yard.

A MOTION was made by Ms. Sette, SECONDED by Mr. Bylaska to accept the Findings as read.

VOTE; IN FAVOR (4) Lennox, Sette, Thurston and Bylaska
            AGAINST   (1) Nugent

DECISION:
A MOTION was made by Ms. Sette, SECONDED by Mr. Bylaska to Grant a Special Permit under Eastham Zoning By-Laws Section VI-D to maintain a horse on property located at 101 Dyer Prince Road, Eastham, Map-19 Parcel-102 with the following conditions: The applicant will submit a satisfactory waste management plan approved by the Chairman of the ZBA  as part of this permit.  Said plan will include procedures for cleaning stall, barn and yard, and will specify type of air tight containers.

VOTE:  IN FAVOR (5) Bylaska, Thurston, Lennox, Nugent and Sette
         AGAINST: NONE
A letter was read requesting Release of Covenant the remaining properties on the Chapter 40B project on Sandy Meadows Lane (18 Lots).

A MOTION was made by Ms. Sette, SECONDED by Mr. Bylaska to Release from Covenant
the remaining properties on the 40B project on Sandy Meadows Lane (18 Lots).

VOTE: IN FAVOR (5) Lennox, Thurston, Bylaska, Nugent and Sette
           
A MOTION was made by Mr. Thurston, SECONDED by Ms. Sette to accept the Minutes of May 11, 2006.

VOTE: IN FAVOR (5) Lennox, Nugent, Thurston, Sette and Intonti (for Bylaska who was absent)
       
A MOTION was made by Mr. Bylaska, SECONDED by Ms. Sette to adjourn at 7:50 PM.
VOTE: IN FAVOR (5) Unanimous
