ZONING BOARD OF APPEALS
May 11, 2006
MINUTES


Members Present: John Lennox, Kathryn Sette, Roger Thurston, William  Nugent, Donald                                                  Intonti , Alternate  for Robert Bylaska                              
                        
Staff Present:          Mary Elizabeth Burgess, Town Planner

Mr. Lennox (Chairman)  called the meeting to order at 7:03  PM.

CASE Z2006-04 -TOWN OF EASTHAM/VERIZON WIRELESS/KEENAN BRINN, seeks     an AMENDMENT OF ORIGINAL LICENSE AGREEMENT Special Permit to allow placement of a commercial generator for backup power at the Tele Communications Site with Cell Tower, for property located at 2770 Nauset Road Rear, Eastham, Map 05 Parcel 31.
                 
The Applicant requested in writing  that he be allowed to withdraw without prejudice.

A MOTION was made by Mr. Thurston, SECONDED by Mr. Intonti to permit the applicant to withdraw without  prejudice
                                                
VOTE: IN FAVOR (5) Lennox, Thurston, Intonti, Nugent and Sette
            AGAINST: NONE



A MOTION was made by Ms. Sette, SECONDED by Mr. Intonti to accept the Minutes of March  9, 2006 as corrected..

VOTE: IN FAVOR (5) Lennox, Nugent, Thurston, Intonti and Sette
        AGAINST - NONE 

A MOTION was made by Ms. Sette. SECONDED by Mr. Intonti to grant a partial release to New Cape Enterprises from covenants for Lots 9, 11, 12, 13, 14, and 18 in the Bay Meadow subdivision known as (Sandy Meadow Way).

VOTE: IN FAVOR (5) Lennox, Nugent, Thurston, Intonti and Sette

        AGAINST - NONE 

Discussion:
 Proposed approach to By-Law changes in the future in concert with the Planning Board.  The Planner is to submit proposed re-codified By-Laws and definitions next fall.  Also discussed were the rolls of the Planning Board and the Zoning Board of Appeals.

A MOTION was made by Ms. Sette, SECONDED Mr. Thurston suggesting that the Planning Board and Zoning Board meet jointly to discuss roles and mutual concerns regarding any proposed Zoning By-Law changes well in advance of the next Town Meeting in order to be supportive.

VOTE: IN FAVOR (5) Lennox, Nugent, Thurston, Intonti and Sette
        AGAINST - NONE 

A MOTION was made by Mr. Thurston, SECONDED by Ms. Sette to adjourn at 8:45 PM.
VOTE: IN FAVOR (5) Unanimous
            AGAINST   -  NONE
