ZONING BOARD OF APPEALS
MARCH 10, 2005
MINUTES

Members Present:, Kathryn Sette-Chair, Roger Thurston and Donald Intonti, Jr.-Alternate

Members Absent:  Robert Bylaska, John Lennox, William Nugent and David Fleming-                          Alternate

Staff Present:  Terry Whalen-Town Planner

Ms. Sette (Chair) called the meeting to order at 7:00 PM.


Continued Hearing - Appeal of a Decision of the Building Inspector:
APPEAL Z#2004-16 - JANE FLEMING, PO Box 1222, North Eastham, MA 02651, Requests an Appeal of the Zoning Officer’s Decision not to issue a Building Permit, under Section VIII (B) of the Zoning Bylaws for a temporary retail structure during alteration of a commercial site for property located at 4680 State Highway, Eastham, Map 08 Parcel 202.


A MOTION was made by Mr. Intonti and SECONDED by Mr. Thurston to continue the hearing until April 14, 2005. The VOTE; 3-0 IN FAVOR (For: Intonti, Thurston, and Sette).


Continued – Special Permit:
APPEAL Z#2005-01 - ALBERT L. PEMBERTON, 25 Bayview Road, Durham, NH 03824, seeks a Special Permit under Eastham Zoning By-Laws Section VI-C to expand by relocating side door and construct dormer in place of skylight  pre-existing nonconforming structure for property located at 720 Campground Road, Eastham, Map 7A Parcel 031.

A MOTION was made by Mr. Thurston and SECONDED by Mr. Intonti to continue the hearing until April 14, 2005. The VOTE; 3-0 IN FAVOR (For: Intonti, Thurston and Sette)

APPEAL Z#2005-04, SOUTHSIDE REALTY TRUST/JOHN MCSHANE TRUSTEE - The petitioner, seeks a Comprehensive Permit under the provisions of M.G.L. c. 40B, §§20-23 to construct 40 units of attached and detached housing units on 11.68 acres, land shown as Assessor’s Map 08, Parcels 191E, 191F & 191G, located off Brackett Road in North Eastham.  It is proposed for “Brackett Landing” that ten (10) of the homes will be affordable at 80% of median income and five (5) units will be affordable at 120% of median income, and 25 will be sold as market rate units.  Approval of the Board of Appeals is required for the issuance of the Comprehensive Permit.  Copies of the application including the complete list of waivers requested are available for review at the Zoning Office in Town Hall.

Chris Kirane (Attorney) representing Southside Realty Trust requested a continuance and noted that the 40B hearing was opened within 30 days as required  and written request to continue to another date certain was unnecessary.

A MOTION was made by  Mr. Thurston and SECONDED by Mr. Intonti  to continue this hearing to April 7, 2005.   The VOTE;  (For Thurston, Intonti and Sette)

Note;  Vote was not taken on minutes as only two of the members present were in attendance at 2/10/05 meeting.

OTHER BUSINESS:

The Board discussed the proposed Zoning Article for Fences proposed by the Planning
