Board of Selectmen
Wednesday, December 5, 2007 – 2:30 p.m.
Work Session

Location:       Eastham Town Hall – Earle Mountain Room

Selectman Burt called the meeting to order at 2:35 p.m.

Barnes Update

Fire Chief Glenn Olson informed the Board that he believes the following tanks are located on the property: one 30,000 gallon home heating oil tank, one 500 gallon waste oil tank, and four gasoline tanks.  He noted that the oil tanks are filled with oil and water, of which the exact mixture is unknown.  Chief Olson also noted that the family claims the gas tanks are empty but have no documentation to prove this.  He noted that the current cost estimate is for locating the vent and fill tubes of the tanks and identifying the tanks’ contents.  Chief Olson added that the monitoring wells do not indicate there has been any leakage from the tanks.  The chief indicated that his primary concerns are public safety and the preservation of the groundwater.  

The Board decided to address this issue when the cost estimate can be finalized and it is affirmed by Town Counsel that the Town has legal permission to investigate on the property.

Flag Policy

The Board discussed a few changes to the policy.  Ms. Vanderhoef noted that the changes will be made and the policy will be brought back to the Board at their next meeting for their approval.

Wastewater Update

Nate Weeks, a consultant from Stearns and Wheeler, updated the Board on the status of the wastewater plan for the Town.  He noted that wastewater planning had been put on hold pending the outcome of an estuary and pond study performed by the Massachusetts Department of Environmental Protection.  Mr. Weeks then proceeded to present an overview of the findings of the Massachusetts Estuaries Project as attached.  

Selectman Collins left the meeting at 4:25 p.m.

Selectman Schropfer questioned if there was anything that can be done by the Town at this stage in the process or whether we needed to wait until all of the data is in.

Jane Crowley, Health Agent, provided an overview of the process.  She noted that we have received a draft document from the Massachusetts Estuaries Project team and that we can now provide comments on the draft.  She added that following the draft stage, a final report will be completed and that there will be a public hearing.  At that time, comments will also be accepted and the regulatory agencies will have to respond to those comments.

Ms. Crowley informed the Board that there is an internal group working on this project.  She added that if any members of the Board would like to make comments they can forward those to her.  

Selectman McDonald then asked Henry Lind, Natural Resources Director, whether Rock Harbor is “impaired.”  Mr. Lind responded in the affirmative and went on to provide an overview of the present condition of Rock Harbor.

Adjournment

Selectman Schropfer made a motion to adjourn the meeting at 4:35 p.m.  The motion was seconded by Selectman Martin and so voted 4-0.
