Tuesday, April 19, 2005
REGULAR SESSION


Present:        Chairman Linda Burt;  Selectman Kenelm Collins, Vice Chair;  Selectman Russell Sandblom, Clerk; Selectman Joyce Brookshire; Selectmen
                Peter Whitlock.   Ms. Sheila Vanderhoef, Town Administrator.

The meeting was called to order by Selectman Burt at 7:00 p.m.


PUBLIC INFORMATION

Selectman Sandblom noted that the recent Ocean Beach fundraiser was very successful and had
received great support from the community.  Mr. Bob Smith (Ocean Beach Committee) also noted that this event was a great success, and that a survey was implemented to get feedback from the community regarding concerns, etc.  Selectman Collins expressed how proud he was of the community and the community spirit witnessed by this event.

7:04 p.m.       Fred Fenlon (Representative, Assembly of Delegates) distributed a copy of the recent meeting of the Barnstable County Assembly of Delegates Standing Meeting on
                Economic Affairs.  Mr. Fenlon wanted to inform the Board of Selectmen on what
                this committee is going to attempt (copy attached).

7:05 p.m.       PUBLIC HEARING - Board of Selectmen/Finance Committee
                FY 06-FY 11 Capital Improvement Plan

Chairman Burt read the Legal Notice for the Proposed Five Year Capital Plan FY 07 - FY 11
(copy attached).

All articles in the Warrant were read, with minor explanatory discussions on the following articles:



Article 6 - Visitors and Services Board Budget - detailed to be able to review how
        funds are expended;


Article 8 - Most accounts in good shape, except for snow and ice;
Article 9 - compensation and classification plan reviewed and adjusted every ten years;
Article 11 - request to fund four new positions (i.e., 4 fire to cover one position;
        Assistant Health Agent; add new position, receptionist/clerk to administrative staff;


Article 12 - Operating Budget - Line 66 - 3% overall increase - to cover change in
        program for elder services;


Article 13 - includes two new ambulances;
Article 14 - Five Year Capital -
        Line 153 - trying to get grant money for Wind Turbine - if no money is obtained,
        may need money to finish it;


Article 15 - Annual Article to fix the salary and compensation of all elected officials;
Article 16 - Chamber of Commerce - Grant - to help support operations of the
        Chamber of Commerce.  The town still maintains portables, grass cutting and major
        building repairs;


Article 18 - Conservation Restriction - needs to be voted in the affirmative at town
        meeting and is still undergoing local Conservation Commission review;


Article 19 - to be postponed;
Article 20 - postponement also under consideration;
Article 21 - a two or three step process - under review - may also be considered
        at Special Town Meeting in August; concerned citizen on impact of snow
        on the elderly; possible meeting with the DPW on these matters to be considered.



8:05    The public hearing with the Finance Committee and the Board of Selectmen closed at
        8:05 p.m.



III.      LICENSING - Transient  Vendor’s Licenses (various) Eastham Painters Guild
        Art Show(s)     

Selectman Collins moved, and Selectman Brookshire seconded the motion to grant Transient Vendor’s Licenses for an Eastham Painter’s Guild art show to be held at the Old Schoolhouse Museum located on Nauset Road from May 28, 2005 through September 18, 2005.
Approved 5-0.




ADMINISTRATIVE MATTERS

A.      Action/Discussion

1651 Forest Committee Charge and Membership

Ms. Vanderhoef noted that Toni Stoker (1651 Forest Advisory Committee) had previously appeared before the Board of Selectmen and had asked for a revision to the charge of  the 1651 Forest Advisory Committee, and to potentially reduce the number of the membership which presently stands at seven.  

Discussion followed with input from the President of the Friends of the Eastham 1651 Arboretum  (i.e., Loretta Nielsen) who noted that the membership of the Friends of the Eastham 1651 Aboretum continues to grow, and that they have planted approximatley one hundred (100) trees. Ms. Stoker noted that Dennis Murley and Henry Lind (Natural Resources Officer) had provided invaluable experience and insight into this project.  Selectman Sandblom said that this was a great project and the creativity of experts as well as non-experts would be very valuable going forward.  Selectman Whitlock was very concerned about active members on this committee who would find that their services were no longer needed if the number of members was reduced.  Additionally, Selectman Whitlock noted that environmental sciences keeps growing and there is ample room for more points of view.  Selectman Brookshire, as liaison for this committee, noted that a great deal of work had been completed, and that it had evolved to another level with the help of the Friends of the Eastham 1651 Arboretum.

Further discussion revolved around keeping the same goals of the committee, and  going from a seven (7) member committee to a five (5) member committee (i.e., one member from the Conservation Committee, Open Space Committee, current President of the Friends of the Eastham 1651 Arboretum, and two members at-large).  There  was also a suggestion that a stipulation be placed on attendance (must attend two of four meetings).  

Ms. Vanderhoof noted that these suggestions would be incorporated in a redrafting of the charge,
with a goal of presenting this before the Board of Selectmen again in the May 16, 2005 or June meeting.  Additionally, current members will stay in their positions through June 30, 2005.

8:35 p.m.       2.  Cape Cod Tech Assessment Formula Correspondence from Provincetown.

Ms. Vanderhoof noted that an E mail had been received from Keith A. Bergman, Provincetown
Manager, requesting that consideration be given to an article recently passed at the April 4, 2005 annual Town Meeting in the Town of Provincetown which read as follows:

“Article 3.  Cape Cod Regional Technical High School Assessment Formula.  To see if the Town will vote to accept the provisions of MGL C.71, §16B, which would reallocate the sum of the member towns’ contribution to the Cape Cod Regional Technical High School District in accordance with the Regional Agreement rather than the Education Reform Formula, so-called, or to take any other action relative thereto.  (Requested by the Town Manager).”

Mr. Bergman asked that attention be brought to this item and considered for inclusion in the next Town Meeting as appropriate.

8:40 p.m.       3.  Community Wind Collaborative Approval for Study.

Selectman Brookshire moved and Selectman Whitlock seconded the motion to send a letter of support to proceed with participation in MTC’s Community Wind Collaborative, in order to
explore Eastham’s Community Wind potential through a feasibility study.  Approved 5-0.

8:45            OTHER BUSINESS



Ms. Vanderhoof noted that she and Selectman Burt were going to the DEP in
        Lakeville, MA to speak about the fence and prohibitive  clean up costs related
        to the Neighborhood Gas Station (Carroll).



Recommendation by Selectman Sandblom to send a letter to Mass Highway
        regarding unsafe condition of potholes;




Cancellation of Board of Selectmen’s Work Session for Wednesday, April 21, 2005;

The Cable Advisory Committee would like to meet with the Board of Selectmen
        regarding exploring options related to cable service (i.e., possible dates offered -
        April 25, 2005 or May 16,  2005).
