DECEMBER 13, 2006
MEETING MINUTES

Members Present:  Howard Sandler, Chairman, Leslie Ann Morse, Michael Cole, Craig Nightingale,                      Peter McDonald, Debbie Abbott and Frank Salomone

Staff Present: Mary Elizabeth Burgess, Town Planner
                
Howard Sandler, Chairman  called the meeting to order at 5:00 PM

ANR:
CASE PB2006-30 - ROSLYN GARFIELD/DAVID J. SKIBA,Trustee, seeks Endorsement of                Plan  Believed Not To Require Approval for property located on Old County Road,
                          Eastham, Map- 02 Parcel- 012.

A MOTION was made by LESLIE MORSE, SECONDED by PETER McDONALD to Endorse Plan Believed Not to Require Approval for property located on Old County Road, Eastham, Map-02 Parcel-012.

VOTE: IN FAVOR (5) Sandler, Morse, Abbott, Nightingale and McDonald

CASE  PB2006-27 - GERARD HILL/EAST CAPE ENGINEERING, INC. seeks Commercial      Site Plan Approval under Eastham Zoning By-Laws Section XIII-B, to construct two (2) mixed use buildings, including seven (7) residential apartments for  property located at 4660 State Highway, Eastham, Map-08 Parcel-201.

A MOTION was made by LESLIE MORSE, SECONDED by DEBBIE ABBOTT to continue this Case to January 10, 2007 Planning Board meeting.

VOTE: IN FAVOR (6) Sandler, Morse, Cole, Abbott, Nightingale and McDonald

CASE PB2006-28 - PUKWUDGIE REALTY TRUST/DOROTHY E. DANIELS, seeks       Residential Site Plan Approval under Eastham Zoning By-Laws Section IX-D-1 to construct an addition to existing structure and also construct basement under a portion of existing dwelling, resulting in a site coverage ratio over 15% for the property located at 33 Bayberry Lane, Eastham, Map-13 Parcel-158.  

THE PLANS WERE REVIEWED AND APPROVED WITH THE FOLLOWING CONDITIONS:


(1.) Subject to Board of Health Approval.
        (2.) Subject to Zoning Board of Appeals Approval:

Findings of Fact:
             (1.)  The project is not detrimental to the neighborhood:
          (2.)  No adverse comments from abutters:

DECISION:
        Based on the Applicant’s request a MOTION was made by LESLIE MORSE   and SECONDED by PETER McDONALD    to APPROVE RESIDENTIAL SITE PLAN to construct an addition to existing structure and also construct basement under a portion of existing dwelling for properety located at 33 Bayberry Lane, Eastham, Map-13 Parcel-158.

THE VOTE:   IN FAVOR (6)  Morse, Sandler, Nightingale, Abbott, Cole and McDonald                      
CASE PB2006-29  - JAMES & AMANDA BAUGHMAN, seek Residential Site Plan Approval  under Eastham Zoning By-Laws Section IX-D-1 to renovate existing dwelling resulting in a site coverage ratio over 15% for the property located at 300 Samoset Road, Eastham, Map-14 Parcel-135.

DECISION:
Based on a letter from the Applicant a MOTION was made by LESLIE MORSE, SECONDED by DEBBIE ABBOTT to allow the Applicant to withdraw without  prejudice.

THE VOTE:   IN FAVOR (5) Sandler, Morse, Cole, Abbott, Nightingale
                     RECUSED (1) McDonald

A MOTION was made by Michael Cole, SECONDED by Peter McDonald to Approve the Minutes of  November 8, 2006 as amended.

THE VOTE: IN FAVOR  (5) Sandler, Morse, Abbott, Nightingale and McDonald
                     RECUSED (1) Cole

A MOTION was made by Leslie Morse, SECONDED by Peter McDonald to adjourn @6:00PM.

THE VOTE:   IN FAVOR  - UNANIMOUS
